How We Keep Your Information Secure
We use secure technology, privacy protection controls, and restrict access to safeguard your personal information.
Among those security technologies, we use the Secure Sockets Layer (SSL), an advanced security protocol that protects your credit or debit card or other payment information and helps to ensure secure online ordering. SSL Internet connections are encrypted so information cannot be read in transit and thereby protect your name, address, and credit or debit card number or other payment information.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the Internet is not completely secure. Although we do take steps to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Websites, social media pages, or other platforms.
Additionally, where you provide any information to be published, displayed, or posted on any public areas of our Websites or on any of our social media pages or other platforms (hereinafter “User Generated Content” or “UGC”), such UGC becomes visible to and accessible by the general public, and we are not responsible for how your UGC (or any personal information you may include in them) may be viewed, shared, or used by others.
We may disclose personal information that we collect or you provide as described in this policy to the following types of third parties for a business or commercial purpose: (i) to our subsidiaries and affiliates, (ii) to our business partners, (iii) to contractors, service providers, vendors, and other third parties who provide services to or for us, such as advertising networks, marketing partners, publishers, and other entities who perform analytics and advertise our products and services on websites not affiliated with us, and (iv) to an actual or prospective buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
We do not “sell” personal information (in the ordinary meaning of the word “sell,” meaning that we do not share personal information with third parties in exchange for money), and we do not “share” personal information (in ordinary meaning of the word “share”) with parties for their own advertising or marketing purposes. However, as described under the heading “California Residents’ Notice at Collection” below, we may disclose your personal information to certain third parties for our advertising or marketing purposes in a way (such as sharing it for cross-context behavioral advertising) that may, under California’s privacy laws, be deemed a “sale” or “sharing.”
Some third-party vendors, like Google Analytics or Facebook, for example, may use cookies, web beacons, and similar technologies to collect information about how you use our Websites in order to perform tracking and marketing analytics or serve advertisements that are more likely to be of interest to you. One way in which you can limit us and these third parties from collecting information about how you use our Websites or from sending you interest-based advertisements is to change your browser settings to reject cookies. If you are a California resident, you may also opt out of the sale or sharing of your personal information, which will limit these third parties from collecting information about how you use our Websites or from sending you interest-based advertisements, as described under the heading “California Residents’ Privacy Rights“ below.
Additionally, if you do not want to receive e-mail marketing communications from us, please refer to the opt-out instructions under the heading Opt-Out Instructions — Your Choice to Limit E-Mail Marketing below.
Our Websites, social media pages, or platforms may also offer links to and from other websites, including third-party websites. Third-party websites have their own privacy policies. If you visit a third-party website, you should review the privacy policy and any terms and conditions for that third party website.
Please be mindful that any User Generated Content that you may post on any of our Websites or any of our social media pages or platforms are, by their very nature, shared automatically with the general public. We do not control, and are not responsible for, how any third parties may share or use any of your User Generated Content.
We may also disclose your personal information: (i) to comply with any court order, law, regulation, or legal process, including to respond to any government or regulatory request, (ii) to enforce or apply our Terms and Conditions and other agreements, including for billing and collection purposes, and (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, identity theft protection, and credit risk reduction.
How Long We Keep Your Information
We expect to retain personal information only for the period necessary to achieve the purposes for which we have collected it and as otherwise permitted by applicable law. We may retain personal information while you remain a customer and for a commercially reasonable time after the termination or deactivation of your account with us for marketing, backup, archival, legal, and/or audit purposes and as otherwise permitted by applicable law. If you are not a customer, we may retain personal information for a commercially reasonable time after collecting your information for marketing, backup, archival, legal, and/or audit purposes and as otherwise permitted by applicable law.
Automatic Data Collection Technology We Use and Third-Party Use of Cookies (and Other Tracking Technologies)
There are three commonly used automatic data tracking technologies used on our Websites: cookies, basket recovery, and clear gifs (also called web bugs or web beacons). We use these technologies to monitor the performance and effectiveness of our Websites and to communicate with you. “Cookies” are small files stored by your browser or placed on your device’s storage medium. Most web browsers automatically accept cookies, but you can usually change your browser to prevent this. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites. Please be assured that accepting a cookie does not give us access to your computer under any circumstances. If you disable cookies, you may be unable to place orders on or use other features of our Websites. If you experience any problems, please e-mail us at [email protected]. Basket recovery is technology we use to identify abandoned shopping carts and to send follow up e-mail communications. If you do not want to receive shopping cart recovery e-mail communications, do not type your e-mail address into any product order form or click the “unsubscribe” button at the bottom of such e-mails. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movement of Web users, count the number of visitors to a specific webpage, determine who opened an e-mail from us, and for other related Website statistics.
In addition, some content or applications, including advertisements, on our Websites are served by third-party service providers, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies (alone or in conjunction with clear gifs or other tracking technologies) to collect information when you use our Websites. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites (including our Websites and third-party websites) and other online services. They may use this information to provide you with interest- or behavior-based advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. However, you may be able to limit these third parties from collecting information about you when you use our Websites or from sending you interest- or behavior-based advertising or other targeted content by setting your browser settings to reject cookies or, if you are a California resident, by opting out of the sale or sharing of your personal information as described under the heading “California Residents’ Privacy Rights” below.
E-Mail Marketing
We want to send you marketing information via e-mail only if you want to receive it. When you visit our Websites, purchase a product or service owned, distributed, or provided by us, provide us with your contact information, or request information from us, we may from time to time send you e-mail messages describing products, services, sales, and offers. If for any reason you no longer want to receive e-mail marketing messages from us, you can opt out of future e-mails at any time by following the opt-out instructions for e-mail marketing in the following section.
Opt-Out Instructions — Your Choice to Limit E-Mail Marketing
When you provide us with your e-mail address, you are automatically opted in to receive marketing e-mails about our products, services, sales and offers. You may elect to stop receiving marketing information at any time by clicking on the “unsubscribe” link in the footer of promotional e-mails, by e-mailing us at [email protected] (please specify “opt-out request” in the subject line), or by sending us a letter to Pet HealthWorks, Inc., Attention: Legal Department, 4130 SW 28th Way, Fort Lauderdale, FL 33312 (please mark the letter “Opt-Out Request”).
Because we are unable to process requests that do not include complete or accurate information, please be sure to provide your full name, complete mailing address, e-mail address (if applicable) and telephone number you have provided to us in any requests to opt out. Once processed, opt-out requests are effective unless they are later revoked by you or unless you later separately sign up again for marketing e-mails.
Please allow sufficient time for your opt-out request to be processed. Please note however, that you generally cannot opt out of service related announcements (i.e., order confirmation, shipping information, customer care notifications, etc.). If you have questions or concerns regarding this statement, please contact us at [email protected].
Text Marketing & Notifications
By providing your mobile telephone number to us, you are subscribing to receive text marketing notifications. That means that you agree to receive recurring automated marketing messages and shopping cart reminder messages at the mobile phone number you have provided.
We determine shopping cart abandonment by using cookies and other tracking technology, to check whether the existing user has already opted in for text marketing.
Consent is not a condition of purchase. Reply “STOP” to unsubscribe and “HELP,” for help. Msg & Data rates may apply.
If you do not wish to be part of our service, you can unsubscribe at any time by texting “STOP,” “CANCEL,” “QUIT,” “END,” or “UNSUBSCRIBE” to any mobile message you received from us. You may get another text message confirming that you have unsubscribed from our service. You also agree that by sending an e-mail, calling in, or sending any other means of opting out or to unsubscribing or using words different from the ones presented above will not be reasonable means to unsubscribe from our service.
When you opt in to receive text messages from us you may expect to get occasional texts concerning latest Text Alerts, Surveys, Welcome messages, Customer Win-backs, Text Campaigns, Giveaways, Flash Sales, Upsells, Feedback or Review Requests, etc. If your device does not support MMS we will deliver a SMS instead and strip the image. Confirmation of receipt of opt-out messages or requests will also be delivered as a standard text message (SMS).
Carriers (AT&T, T-Mobile, Verizon, Sprint, Rogers, MetroPCS, etc.) are not responsible or liable for undelivered or delayed messages.
